As brands continue to compete for visibility during major sporting events, “ambush marketing” strategies have become increasingly sophisticated — particularly in digital campaigns and social media activations.
In Dominican Republic, while ambush marketing may be perceived as commercially aggressive or “parasitic,” there is currently no specific legal framework expressly prohibiting these practices.
This raises an interesting question: when does a marketing campaign cross the line from creative advertising into unlawful association?
From a Dominican legal perspective, the analysis often centers around three key areas:
- potential infringement of intellectual property rights;
- unfair competition and unlawful exploitation of third-party reputation; and
- misleading or deceptive advertising.
Interestingly, not every indirect reference to a sports team, event, or sponsor will necessarily create legal exposure.
For example, campaigns making use of color combinations, visual references, seasonal context, or generic sports imagery — without using official trademarks or logos — may still present relatively low practical enforcement risks under current local standards.
That said, each case will always depend on the specific context and, particularly, on whether consumers could reasonably perceive an association, sponsorship, or endorsement that does not actually exist.
In practice, establishing free riding of third-party reputation or demonstrating likelihood of confusion may require complex and costly evidence, including consumer surveys and market studies — a reality that continues to make enforcement particularly challenging in the Dominican market.
As sponsorship investments continue to grow across sports and entertainment industries, it will be interesting to see how regulators and courts in Dominican Republic approach these evolving marketing strategies in the years ahead.
